Introduction

These terms and conditions (Terms) apply when you access or use www.christianrentals.org (Website). You agree to be bound by these Terms which form a binding contractual agreement between you and us, Faithful App Ltd (company no. 17247090), trading as Christian Rentals, with its registered office at 124-128 City Road, London, EC1V 2NX, England(‘Christian Rentals’, the ‘Company’, ‘we’, ‘our’ or ‘us’).

If you don’t agree to these Terms, you must refrain from using the Website.

We may change these Terms at any time by updating this page of the Website, and your continued use of the Website following such an update will represent an agreement by you to be bound by the Terms as amended.

Access and use of the Website

You must only use the Website for lawful personal or business browsing purposes, including to access information about Christian Rentals and, where available, to navigate to our separate platform terms for registered users, listings, accounts, paid services and related marketplace features. Marketplace and listing functionality is available only in locations supported by the platform from time to time. You must use the Website in accordance with these Terms and any applicable laws, and must ensure that anyone who uses or accesses the Website on your behalf does the same.

Your obligations

You must not:

  • copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Website without our express consent;
  • use the Website for any purpose other than browsing or accessing information about Christian Rentals and its property listings and introductions platform;
  • use, or attempt to use, the Website in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity;
  • use, or attempt to use, the Website in a manner that may interfere with, disrupt or create undue burden on the Website or the servers or networks that host the Website;
  • scrape, crawl, harvest, index or otherwise extract data from the Website, or use the Website with the assistance of any bot, spider, scraper, crawler, automated scripting tool or software, except to the extent permitted by law or by our robots.txt file;
  • act in a way that may diminish or adversely impact our reputation, including by linking to the Website in a way that is unlawful, misleading, defamatory or otherwise harmful; and
  • attempt to breach the security of the Website, or otherwise interfere with the normal functions of the Website, including by:
    • gaining unauthorised access to Website accounts or data;
    • scanning, probing or testing the Website for security vulnerabilities;
    • overloading, flooding, mailbombing, crashing or submitting a virus to the Website; or
    • instigate or participate in a denial-of-service attack against the Website.
  • provide false, misleading, or inaccurate information about yourself or, if you are acting on behalf of an organisation, about your organisation, your authority to act, or any information you submit to us via the Website;
  • impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; and
  • upload, post, or share content that is inappropriate, offensive, unlawful, or harmful.

Platform terms

These Terms apply to general browsing of the Website. They do not govern the creation or use of registered accounts, property listings, identity verification, listing compliance questions and related responses, messaging, paid listing services, Boost services or other marketplace functionality, which are governed by our separate Platform Termswhere they apply. Where the Website describes, previews or links to listings or paid platform features, you acknowledge that some listing positions, prominence, ranking or visibility may be affected by paid features, including Boost. Where a listing’s position or prominence has been influenced by a paid feature, we will identify it as such by means of a clearly visible label, and further details of how paid features affect ranking will be provided on the relevant platform pages or in the Platform Terms.

If you create an account, submit a listing, contact another user, pay for a listing or use any registered-user or paid service, you must comply with the Platform Terms as well as any terms presented to you at the time.

If there is any inconsistency between these Terms and the Platform Terms in relation to registered-user or paid platform services, the Platform Terms will apply to that service to the extent of the inconsistency.

Disclaimers and limitation of liability

The Website and any information made available on it are provided on an ‘as is’ and ‘as available’ basis. To the fullest extent permitted by law, we disclaim all warranties, representations and conditions (express or implied) in relation to the Website and any Website Content, including any implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement.

You acknowledge that any Website Content, including any housing, tenancy, deposit, safety or location-specific guidance for England, Wales, or Scotland, is general information only. It does not constitute legal, property, tenancy, financial, safety or other professional advice, recommendation or endorsement, must not be relied on as legal advice, and you should obtain independent advice from an appropriately qualified adviser before acting on it.

You are responsible for your use of the Website and for evaluating the suitability of any property, listing, landlord, tenant, housemate, agent, third party product, third party service or other opportunity that you become aware of through the Website.

The Website may describe or reference third party offerings and may enable you to contact, view, list, advertise or otherwise engage with landlords, tenants, housemates, agents or other third parties through separate platform functionality. We operate Christian Rentalsas an online listings and introductions platform only and are not a letting agent, landlord, tenant, property manager or party to any tenancy, licence, deposit, rent payment or other agreement between users. Any arrangements you enter into with third parties are between you and the relevant third party and are subject to that third party’s terms and policies.

We do not endorse, guarantee, warrant or verify the quality, suitability, legality, availability, ownership, right to let, safety, condition, accuracy or existence of any property, listing, user, landlord, tenant, housemate, agent, third party service provider or services advertised, listed or arranged through the Website.

Where the Website asks or displays factual questions or answers about a property, occupation, ownership, letting status, agency status, registration, licensing or similar matters, those questions and answers are used to help determine which platform registration, licensing, declaration or information requirements may apply before publication. We do not ask advertisers to self-certify statutory exemptions, and we do not verify any landlord registration number, licence number or similar number against the Scottish Landlord Register, Rent Smart Wales or any other public or private register. Any such number or related information shown on or through the Website is the advertiser’s own statement and not our verification or endorsement of it.

To the fullest extent permitted by law, we will not be liable to you for any loss or damage (whether in contract, tort (including negligence), breach of statutory duty or otherwise) arising out of or in connection with your use of (or inability to use) the Website, reliance on any Website Content, or any act or omission of any user, landlord, tenant, housemate, agent, third party service provider or other third party, including any indirect or consequential loss, loss of profits, loss of revenue, loss of business, loss of goodwill or loss of data. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your non-excludable rights under applicable consumer law.

Information on the Website

While we seek to keep the Website up-to-date and functioning properly, you acknowledge and agree that from time to time, you may encounter the following issues:

  • the Website may have errors or defects;
  • the Website may not be accessible at times;
  • messages, forms, links, reports or other communications sent through or via the Website may not be delivered promptly, or delivered at all;
  • information you receive or supply through the Website may not be secure or confidential; or
  • any information provided through the Website may not be accurate or true.

We reserve the right to change any information, content or functionality on the Website by updating the Website at any time without notice, including any guidance, links, descriptions, availability information, marketplace references, profiles and other Website Content.

Events outside our control

We will not be responsible for any failure or delay in making the Website, platform links, listings, forms, messages, paid features, Boost visibility, verification flows, payment links or other Website functionality available where that failure or delay is caused by events outside our reasonable control, including outages or failures of hosting, internet, telecommunications, payment, mapping, identity verification or other third party service providers, cyber incidents, denial-of-service attacks, malware, security incidents, maintenance, changes in law, regulatory action, strikes, labour disputes, utility failures, fire, flood, severe weather, epidemic, pandemic, war, terrorism, civil unrest or other events beyond our reasonable control. We will take reasonable steps to minimise the effect of such events where it is practical for us to do so.

Intellectual property

We retain ownership of the Website and all materials on the Website (including text, graphics, logos, design, icons, images, sound and video recordings, downloads, software, trade marks and branding) (Website Content) and reserve all rights in any intellectual property rights owned or licensed by us that are not expressly granted to you.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website and make a temporary electronic copy of all or part of the Website for the sole purpose of viewing it for your own lawful use. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify, publish, scrape, harvest, commercially exploit or create derivative works from the Website or any Website Content without prior written consent from us or as permitted by law.

The Website may contain links to other websites, platforms, services, payment providers, mapping providers, property services or user-provided resources that are not our responsibility. We have no control over the content, availability, security, policies or practices of linked websites or third party services and we are not responsible for them.

Inclusion of any linked website or third party service on the Website does not imply our approval, verification or endorsement of that linked website, third party service, property, listing, user or content.

Security

We do not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Website. You should take your own precautions to ensure that the process that you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference.

Marketplace positioning

Christian Rentals provides the Website as an online presence for its property listings and introductions platform. These Terms govern general browsing of the Website only and do not replace our Platform Terms for registered users, listings, identity verification, listing compliance questions and related responses, messaging, paid services or other platform functionality.

Nothing in these Terms creates any agency, partnership, joint venture, employment, worker, contractor or fiduciary relationship between Christian Rentals and any user, landlord, tenant, housemate, agent or third party service provider, or between users themselves.

Any tenancy, licence, deposit, rent payment, viewing, property arrangement or other agreement arranged through or following use of the Website or platform is solely between the relevant users or third parties, unless we expressly state otherwise in writing.

General

Governing law and jurisdiction. These Terms are governed by the laws of England and Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales and courts of appeal from them in respect of any proceedings arising out of or in connection with these Terms, except that if you are a consumer resident in Scotland you may bring proceedings in your home jurisdiction. Nothing in these Terms affects any mandatory rights or remedies you have under applicable consumer law.

Waiver. No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

Severance. Any term of these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of these Terms is not limited or otherwise affected.
